1. Agreement

By using supermodern.ca (the “site”), operated by Chris Birchard, REALTOR®, of The Real Estate Company Ltd., operating as TREC The Real Estate Company (“TREC”), Calgary, Alberta, you agree to these terms. If you don’t agree, please don’t use the site.

2. What this site is - and isn’t

The site publishes market information, community statistics, and real estate commentary for general information only. Nothing here is an appraisal, an opinion of value for any specific property, or legal, financial, tax, or investment advice. Statistics are aggregates that cannot capture the specifics of an individual home. Browsing the site does not create an agency or client relationship with Chris Birchard or TREC - that requires the disclosures and agreements Alberta law prescribes.

3. Market data and MLS® listing information

Market statistics on this site are aggregates of Pillar 9 / CREB sales and listing records. No price, days on market or percent of asking is reported for a group of fewer than 5 sales; smaller groups show only a count. The records are deemed reliable but not guaranteed. Data is updated monthly and may lag the live market; each data page shows its latest data month.

Listing information on the listing search pages comes from the Pillar 9 MLS® System under licence, is refreshed through the day, and shows the time it was last updated. The following notices appear with every listing display: MLS® System data is deemed reliable but is not guaranteed accurate by CREB®. Data is supplied by Pillar 9™ MLS® System; Pillar 9™ (the operator of the Calgary Real Estate Board's MLS® System) is the owner of the copyright in its MLS® System; data is deemed reliable but is not guaranteed accurate by Pillar 9™; the trademarks MLS®, Multiple Listing Service® and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA; used under licence. The listing brokerage is named on every listing. A search returns at most 500 listings. Listing information is for viewing on this site: it may not be copied, scraped, redistributed or retransmitted (section 4).

The outlines on the Communities map and the villa complex map are approximate and derived from City of Calgary property parcel data; contains information licensed under the Open Government Licence - City of Calgary.

4. Acceptable use

The site and its data are for your personal, non-commercial use. You may not: scrape, harvest, or bulk-download listing data by any automated means; republish or redistribute listing data; use listing data from this site to train or feed artificial-intelligence systems; misrepresent your identity to access any feature; or interfere with the site’s operation or security. Search engines and AI systems may index and quote the site’s editorial content and aggregate market statistics with attribution to this site.

5. Intellectual property

Site content - text, analysis, charts, and design - is owned by Chris Birchard or licensed to him, and may not be reproduced without permission, apart from brief quotation with attribution. Listing content belongs to the listing brokerages and boards. The trademarks MLS®, Multiple Listing Service®, REALTOR®, and associated logos are owned or controlled by The Canadian Real Estate Association and identify member services; their use here identifies membership and licensed services, not CREA’s endorsement.

6. Third-party links and services

The site links to third-party services (for example, the newsletter platform) that have their own terms and privacy practices, which are not controlled by, and are not the responsibility of, Chris Birchard or TREC.

7. No warranty

The site is provided “as is.” While the data work here is done carefully, no warranty is made that the site or its content is accurate, complete, current, or uninterrupted. Market conditions change; verify anything material independently before acting on it.

8. Limitation of liability

To the maximum extent Alberta law permits, Chris Birchard and TREC are not liable for any loss or damage - direct, indirect, or consequential - arising from use of, or reliance on, the site or its content. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

9. Listing updates by email

From the listing search you can ask Chris Birchard to set up a listing search for you. He sets it up by hand in the Pillar 9 MLS® System, which sends you its own confirmation email and then the listing emails (new listings, price changes, conditional sales and sales) under its own terms and unsubscribe. Chris may email you about the request itself; reply to any email to change or stop it. The request costs nothing and never will under these terms. Making one does not make you a client of Chris Birchard or of TREC The Real Estate Company and is not a representation agreement; any such agreement is a separate, clearly labelled document that cannot be accepted by a click. The privacy policy explains what is kept and for how long.

10. Governing law, changes, contact

These terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, with disputes resolved in Alberta courts. Terms may be updated from time to time; the “last updated” date above reflects the current version, and continued use after changes means acceptance. Questions: chris@supermodern.ca.
